1. Acceptance of Terms
By accessing or using Course37, a product of Shaitrish, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.
2. Description of Service
Course37 is a multi-tenant educational platform that provides organizations with tools for course management, exam creation, live classes, payment processing, website hosting, and AI-powered student support. Each organization operates under its own branded subdomain or custom domain.
3. Educational Use Only
Course37 is provided solely for lawful educational purposes. Organizations and users may use the platform only to deliver, manage, or participate in teaching, learning, assessment, and related academic activities.
- The platform may not be used for any non-educational, commercial-unrelated, or unlawful purpose.
- Content hosted on the platform must serve a genuine educational function.
- Using the service in a way inconsistent with its educational purpose is a violation of these Terms.
4. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must be at least 16 years old to create an account.
5. Organization Responsibilities
Organizations using Course37 agree to:
- Provide lawful and accurate content on their platform.
- Comply with all applicable laws regarding data protection and education.
- Not use the platform for any illegal, harmful, or fraudulent activities.
- Maintain appropriate relationships with their students and users.
6. Content Ownership
- Organizations retain ownership of all content they upload to the platform (courses, exams, documents, etc.).
- Course37 does not claim ownership of your content.
- By uploading content, you grant Course37 a license to host, display, and distribute that content as necessary to operate the service.
7. Setup and Onboarding Fees
Depending on the organization type and specific situation, an initial one-time setup fee may apply before or during onboarding. This fee covers work performed by Course37 to set up the organization, which may include:
- Building and configuring the organization's website.
- Connecting and configuring a custom domain.
- Importing existing data (courses, students, records, etc.) into the platform.
- Other custom configuration or migration work required for launch.
The need for, and amount of, any setup fee is determined by the Course37 authority following a screening of the organization and its requirements. The applicable fee will be communicated and agreed before the work begins.
8. Payments and Billing
- After onboarding, organizations are billed on a recurring basis according to the standard plan they select.
- Setup and onboarding fees (see Section 7), where applicable, are separate from and in addition to recurring plan fees.
- Payment processing is handled by third-party gateways (Stripe, PayPal, SSL Commerz, bKash).
- All fees are non-refundable unless otherwise specified in our Refund Policy.
- We reserve the right to change pricing with reasonable notice.
Overdue payments.If an organization's payment remains due for more than two (2) months, the Course37 authority may deactivate the organization until all outstanding payments are cleared. Deactivation suspends access to the platform; data is retained during this period and access is restored once the dues are settled.
9. Support, Bug Fixes and Feature Requests
- Bug fixes. For issues or bugs in existing features and modules, it is our responsibility to fix them as soon as possible after they are reported, at no extra charge.
- New features. If an organization requests a feature that the platform does not already provide, we will need time to design and build it. New feature development is charged as an extra fee, based on the complexity of the task. Scope, timeline, and cost will be agreed before work begins.
10. Prohibited Activities
You may not:
- Reverse engineer, decompile, or disassemble any part of the platform.
- Use the service to distribute malware, spam, or harmful content.
- Attempt to gain unauthorized access to other accounts or systems.
- Interfere with the proper functioning of the platform.
- Violate any applicable laws or regulations.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from service interruptions.
12. Limitation of Liability
To the maximum extent permitted by law, Course37 and Shaitrish shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.
13. Termination, Suspension and Ban
We reserve the right to suspend or terminate your account if you violate these terms. You may also terminate your account at any time. Upon termination, your right to use the service ceases, and we may delete your data after a reasonable retention period.
We may also deactivate, suspend, or permanently ban any non-paying user or organization that fails to follow these Terms or our policies. Where appropriate, we may provide notice before taking such action, but reserve the right to act immediately in cases of serious or repeated violations.
14. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or a notice on our platform. Continued use of the service after changes constitutes acceptance of the updated terms.
